Plaintiff, 17 years
old at the time, was a passenger in a speeding vehicle that was pulled
over by New York City police officers. Plaintiff claimed he was forcibly
removed from the vehicle, placed face down on the pavement and kicked
in the testicles. He was then transported to the precinct. Shortly
thereafter plaintiff was released by the police; he was never charged.
The offending police officers denied assaulting plaintiff, and were
acquitted of all criminal charges. Plaintiff suffered a ruptured testicle
which had to be surgically removed. As a result plaintiff suffered
from a low sperm count and had not been able to father a child as
of the date of settlement. The City argued that the assault never
occurred, that the plaintiff’s testicle was injured independent
of the event, and that plaintiff was not clinically sterile. On the
eve of trial Amy Rosenbloom negotiated a settlement of $1,750,000
for plaintiff. |
