Plaintiff was operating a van in connection with his employment when he was struck on the side by a truck backing out of a gas station. The impact resulted in only moderate damage to plaintiff's van. Plaintiff refused medical treatment at the scene, but went to an emergency room later that day complaining of back pain. Plaintiff had herniated the L5-S1 disc in his lower back a few years earlier. An MRI taken 2 months post-accident revealed the herniation had increased in size. After an unsuccessful course of physical therapy, plaintiff had a one level laminectomy and fusion of lumbar vertebra at L5-S1. He never returned to work. Amy Rosenbloom obtained the settlement at a mediation prior to trial. |
