Plaintiff’s motor
vehicle was stalled on the highway when it was struck in the rear
by another vehicle. Plaintiff was taken by ambulance to an emergency
room, where she complained of neck and back pain. Plaintiff had 2
prior injuries to her lower back. MRIs taken at the direction of her
private doctor revealed disc hernations in her lower back. Plaintiff
treated conservatively with a physical therapist. At trial plaintiff’s
doctor opined that plaintiff’s injuries were related to the
most recent accident, and are permanent. Defendant disputed the severity
of the injury and argued that any existent injuries were not related
to the accident. Barry Weiss tried the case. The jury awarded plaintiff
$60,000 for past pain and suffering and $800,000 for future pain and
suffering. |
